Apple Denied Preliminary Injunction Request Against Samsung in the US

This is a big victory for Samsung in the US, which could change the course of legal battles between the two companies in other countries. Reuters reports:

Apple failed to convince a U.S. judge to block Samsung Electronics from selling Galaxy smartphones and tablets in the U.S. market, depriving the iPhone and iPad maker of crucial leverage in a global patent battle between the two companies.

I wish Apple and Samsung would reach an agreement so we can put this behind us once and for all.

Apple Gives Samsung List of Workarounds for Design Patents

Unless you've been living under a rock for the last 6 months, chances are you're aware of the ongoing feud between Samsung and Apple. It all started with Apple filing a patent infringement suit against the Korean company for copying its product designs.

The lawsuits have turned out to be a nightmare for Samsung, as the company has been banned from selling its Galaxy tablet in multiple countries, including Germany and Australia. Apparently, Samsung could have avoided all of this with a few, simple design changes...

Australian Court Extends Galaxy Tablet Ban One Week

A week after overturning a Samsung tablet ban ruling in Australia, a judge has now extended the ban for one more week, as reported by Bloomberg:

Apple Inc. (AAPL) won a one-week extension of a ban on Samsung Electronics Co.’s sales of its latest tablet computer in Australia, delaying pre-Christmas sales, in a battle that began in April in the U.S. and spread to four continents.

High Court Justice John Dyson Heydon today extended the ban on the release of Samsung’s Galaxy Tab 10.1 to Dec. 9. On that day, the country’s top court will consider Apple’s request for permission to appeal a lower court’s order issued earlier this week, which lifted a ban on the product that has been in place since mid-October.

Samsung Continues Anti-Apple Campaign with “Old School” Facebook Ad

Last week, Samsung started airing its latest TV ad which not-so-subtly poked fun at iPhone users. The commercial showed a group of young adults, waiting in what appeared to be a line for the new iPhone, drooling over a Galaxy S II handset.

A lot of folks dismissed the advert as bad marketing, as you typically don't want to criticize the audience you are trying to attract. But judging by its Facebook page, it seems the commercial was only the beginning of Samsung's anti-Apple campaign...

Australian Court Overturns Samsung Tablet Ban Ruling

It looks like Christmas came early for Samsung this year. Gizmodo is reporting that an Australian court has overturned the injunction against the Korean company that banned it from selling its popular Galaxy tablet on the continent.

The ban is the result of an ongoing world-wide patent dispute between the two companies and has been in place since late Summer. But, apparently, Samsung made a good case in its appeal it filed last week because the injunction has been lifted...

Samsung Won’t Try to Block iPhone 4S Sales in Korea

Looks like Samsung changed their mind about trying to block sales of the iPhone 4S in Korea.

Samsung Electronics has decided not to seek an injunction against the sale of Apple's iPhone 4S in the domestic market. The new iPhone went on sale here last Friday. Samsung had debated until the last moment whether to file the motion after making similar applications in France, Italy, Australia, and Japan.

The decision was apparently driven by public-relations concerns. A senior Samsung executive said, "We concluded that we should engage in legal battles with Apple only in the global market, but not in order to gain more market share in Korea."

I guess Samsung would rather engage legal battles in larger markets, like France, Germany, etc... This is obviously a work in progress.

Samsung Being Investigated for Possible Antitrust Practices

Samsung has requested that Apple hand over the source code for the iPhone 4S firmware along with the dark details of its iPhone subsidy agreements with Australian carriers. If anyone doubted whether Samsung really meant business in its pursuit of total smartphone marketshare ownership, this one little tidbit to come of the company's earnings call might just help to put the record straight.

During a call to discuss Samsung's most recent financial results, the company's spokesman, Robert Yi, said that Samsung was working on a flexible display for its upcoming smartphones and tablets.

There's a headline bouncing around the tech blogs this morning that goes something like this: "Samsung Overtakes Apple to Become Top Smartphone Manufacturer." The news comes in wake of Samsung's earnings report it issued to investors this morning.

The Korean handset maker didn't offer any specific numbers, but it did tell shareholders its smartphone shipments were up 40% this quarter. Some analysts are estimating that the increase equals 28 million smartphones, which clearly beats Apple's 17 million, right?
