Unless you’ve been living under a rock for the last 6 months, chances are you’re aware of the ongoing feud between Samsung and Apple. It all started with Apple filing a patent infringement suit against the Korean company for copying its product designs.

The lawsuits have turned out to be a nightmare for Samsung, as the company has been banned from selling its Galaxy tablet in multiple countries, including Germany and Australia. Apparently, Samsung could have avoided all of this with a few, simple design changes…

The Verge has gotten its hands on some legal briefs from Apple’s request to ban Samsung’s products, and the documents contain some pretty interesting details:

“One of Samsung’s arguments in its defense against the injunction is that Apple is trying to improperly cover various functional elements required in any modern smartphone or tablet device. Samsung is essentially saying that it had no other realistic design options available when it created devices like Samsung Galaxy S, Infuse, and Galaxy Tab 10.1.”

Apple disagrees, obviously, and listed several alternative design options that Samsung could have investigated. Here are a few of them, as noted by The Verge, that Apple recommended for Samsung’s smartphones:

  • Front Surface that isn’t black.
  • Overall shape that isn’t rectangular, or doesn’t have rounded corners.
  • Display screens that aren’t centered on the front face and have substantial lateral borders.
  •  Non-horizontal speaker slots.
  • Front surfaces with substantial adornment.
  • No front bezel at all.

And as for Samsung’s tablets:

  • Overall shape that isn’t rectangular, or doesn’t have rounded corners.
  • Thick frames rather than a thin rim around the front surface.
  • Front surface that isn’t entirely flat.
  • Profiles that aren’t thin.
  • Cluttered appearance.

Although you may not agree with Apple’s lawsuit binge, you have to admit that Samsung could have done a better job differentiating itself from the competition. And contrary to popular belief, Apple’s attempts to protect its intellectual property seem more likely to spur innovation rather than to block it.

  • Overall shape that isn’t rectangular… seriously. I love Apple’s products but this is extreme douchebaggery. From now on, you can only make products that are shapes other than rectangles. Apple has all the rights to rectangles so choose something else.

  • Stupid. “Front surface that isn’t black” the majority of electronics for 40+ years have been black, It’s not like Apple was the first to create a black device. “Overall shape that isnt rectangular” ummmm HELLO, a rectangle is a standard shape for any cellphone, laptop, notebook or tablet(again Apple was not the first). “Non-horizontal speaker slots” The slots have to be horizontal to fit on a device with such a short profile.

    I am so sick of Apple thinking they own the rights to such unoriginal and old concepts. Just because you make a good product does not mean you can make it impossible for any other company to make a product that even remotely resembles yours.

    Apple needs to get off their high horse and start focusing more on improving their devices instead of suing the shit out of anyone who tries to compete with them.

        Competition is a normal thing and it is a GOOD thing. It’s been present since the beginning of the industrial revolution and it is NEVER going away, so you might as well just get used to it.

Don’t act like you are in the dark , before this courts battle , regular everyday ppl were even saying how the samung galaxy’s starting to look more and more like iPhone. Their not going after droids , bb storms, pre,htc desire, motorala electricfy , or other failed or sUccesful touch devices, they’re going after the one who’s trying to closely resemble the iPhone.

    But seriously though, Samsung is really crossing some lines with this tablet. My dad walked into the room while I was reading the article and after reading the title said, “Damn, I really thought that was an iPad”

    • Even though I disagree with Samsung’s anti-Apple campaign, and think it’s too much, I like their products since they beat the shit out of all Nokia’s S60V5 by releasing Omnia HD, which is still the best S60 5th Edition phone. It proved they are worthy, after releasing so many bullshit devices like SGH-D600, etc.
      Never underestimate your competitor, Samsung are capable, especially hardware-wise.

      • Yeah I own both iPhone 4 16GB (from recently) and still using my Nokia N97 for music (30GB + 8GB memory card) and calls. I just don’t trust that iPhone, it seems like a blurry area where I don’t know what Really is happening when I’m connected to the internet… more of an experimenting device to me, a gadget, nothing more.

    • In my country, most people have iPhone mostly because it’s cool. Others say they like it because “it’s simple”… and I’m like “dude… if you like it simple, then why the hell do you need a SMARTphone”? It’s all because people think that what is the most expensive is certainly the best… wrong. In my country, Galaxy SII = $670… ow and iPhone? About $930. Not worth the gap.

    Here in my country, an iPhone is worth just as much as gold, and Android phones however, are rather cheap. So I tried a Galaxy S2 and LOVED IT. But I also love the iPhone (had one since the 3G came out). Should I get a Galaxy S2 or an iPhone 4?

    • Good luck getting an unbiased answer to that question here lol. If you want the 4G speed and the larger screen, the Galaxy S2 is a great alternative to the iPhone. It comes down to what best suits you.

        Well, the only thing that’s pulling me towards the iPhone is jailbreak anyway (and the beautiful Retina Display).

      • To be fair, jailbreaking on iOS 5 is pretty pointless at moment, at least for those who only use a few tweaks. It is now only really useful if you’re either still on iOS 4 or lower, rely on jailbreak apps such as MyWi or actually still use all of the tweaks you’ve installed over the past few years. That’s my opinion anyway.

      • Yes the screen is magnificent. But that’s all about it. It’s only the screen resolution. Well, maybe iOS is more secure, but it’s in a cost – it protects itself even from you.

    • There is no worthless phone – there are different needs.
      If all you do is play with your phone, iPhone will do well, but if you look for the best hardware and the best developing market (except the screen’s resolution, of course), take the Galaxy SII. It is no secret that Android is progressing, it’s not going to die anytime soon. Actually, statistics show that Apple is the one losing in market share.

    I agree they could have changed something, but Apple is after one thing, and that is moey. If they wanted to avoid making themselves look like greedy a**holes than they could have simply asked Samsung to consider a different design. But idk, maybe they did and Samsung refused. But either way, in my opinion, If I was Apple, I wouldnt have sued them. Apple has iOS. What else could they ask for. How much more money do they really need. If they came out with tablets that resembled Apple products like the iPhone 3GS, (the more curvier Apple products) I bet they wouldnt sue them. But no, they,re products cant resemble what the newest products look like, like every single company in the world does in every aspect of marketing. No body has sued them. But Apple is allowed to do it. BS!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

    • Apple should be sued for suing companies for something Apple doesn’t directly own. Apple can be sued for using a touch-screen, that was used way back in 2000 on Ericsson devices…

  • What a lot of people are missing from this is that Samsung is a supplier of multiple components that go into apple products…damn near all android tablets look somewhat similar, but apple isn’t suing them just Samsung because it made a similar looking device while being contracted by apple
