Apple and Samsung to battle it out over damages this fall

It seems like it’s been a while since we’ve heard any news on the Apple/Samsung lawsuit front, which is not necessarily a bad thing. But today, the silence was broken as Judge Lucy Koh issued a new case management order to the two sides.

According to the order, the two will be battling it out over damages from their August trial this fall, with the next hearing scheduled for November 12. Here, Apple will get a chance to get back some of the $500M Koh cut from its settlement earlier this year… Read More

 

ITC judge finds Samsung guilty of infringing on Apple’s text selection patent

In a decision issued on March 26, but kept classified until earlier this week, an International Trade Commission judge found Samsung to be infringing on Apple’s US RE41,922 patent that covers things like text selection and translucent buttons.

It’s only a preliminary decision, and the judge only found Samsung guilty of infringement on one of two patents listed in the complaint. But if the decision gets upheld, Samsung could once again be looking at a major product ban in the US… Read More

Nokia files brief in support of Apple’s bid to ban Samsung products

Judge rules that Samsung did not ‘willfully’ infringe on Apple’s patents

Last August, a California jury found Samsung guilty of infringing on several Apple patents in a high-profile trial. The initial damages awarded to Apple totaled $1.05 billion, but since Samsung was found to have ‘willfully’ infringed, that amount was expected to multiply.

Samsung delays Galaxy tablet suits with iPad invalidation claims in Spain

In an effort to minimize the impact of last year’s ruling by a Dusseldorf court which issued an EU-wide ban on Samsung’s flagship Galaxy Tab 10.1 tablet over Apple’s design patents pertaining to the iPad, Samsung thinks it’s found a nice way to weasel its way out of this mess. And

Samsung’s answer to this is simple, really: instead of fighting Apple’s re-asserted claim that its Galaxy tablets “slavishly” copy the iPad, Samsung figured it could delay the lawsuits in Germany by filing an invalidity bid in in another country, Spain. As a result, the German suits over the design of the products are scheduled to be put on hold until the process in Spain is completed. If all venues are used, the process can take as long as four years… Read More

 

Court won’t seal Samsung sales data

Samsung of South Korea has lost its bid to keep court records sealed indicating how many products were sold. Samsung facing $15B fine for asserting standard-essential patents against Apple

Reuters reported last week that the European Union would “very soon” formally charge Samsung for asserting standard essential patents against Apple.

Smelling danger, just days prior to the development the Galaxy maker had withdrawn all its injunction requests in European courts.

Samsung sues Apple over Notification Center in Korea

Apple appeals Judge’s decision to dismiss Samsung injunction

As expected, Apple is filing for an appeal on Judge Koh’s decision to throw out its request for a permanent injunction against Samsung’s products. In addition to the $1 billion in damages it won back in August, the iPad-maker was seeking a US sales ban on all of Samsung’s infringing devices.

But in a pair of rulings handed down Monday, Koh denied both Samsung’s request for a re-trial due to jury misconduct, and Apple’s injunction request, noting that it would not be in the public’s best interest to halt Samsung handset sales when only a few features were found guilty of infringement… Read More

 

EU to file antitrust charges against Samsung

The European Union will “very soon” charge Samsung over its practice of filing injunctions against Apple in Europe, Reuters reported Thursday. The news arrives after Samsung dropped all of its injunctions and injunction requests against Cupertino, California-based Apple’s gadgets in Europe and following a U.S. ruling that threw Samsung’s alleged jury misconduct claim out of the window.

US Patent Office invalidates another key Apple patent

We’ve seen the United States Patent and Trademark Office reject or invalidate a few important Apple patents in the last few months, including one covering the infamous ‘rubber banding‘ UI feature, and one covering the iPhone.

Judge denies Apple’s injunction request, throws out Samsung’s misconduct claims

While the high profile Samsung-Apple trial technically ended back in August, with Apple winning a staggering $1 billion judgement, the fallout is far from over. The two companies must still endure countless post-trial hearings and their subsequent appeals.

Judge says patents involved in Apple-HTC deal must remain unsealed

In a ruling late last night, US District Court Judge Lucy Koh ordered that the patents Apple and HTC are cross-licensing as part of their settlement are to remain unsealed, suggesting that the public will eventually get a look at this information.

From Russia without love: iPad patent appeal rejected

Apple’s two-year attempt to get the iPad design patented in the Russian Federation hit a dead-end, when regulators ruled there was nothing “distinctive” about the tablet’s makeup. The company had appealed an April rejection by the Russian Patent Office. This most recent rejection by the Russian Chamber for Patent Disputes seems to close the door on gaining a patent for the best-selling tablet.

In its response to Apple, written in Russian, the chamber ruled the iPad patent application – which describes rounded corners, a flat surface and round button beneath the screen – involves a design that is “traditional for modern communication devices, manufactured by different vendors”… Read More
