Apple vs Samsung (image 002)

The verdict has just been given in the second trial opposing Apple to Samsung, which has taken place in California over the last month.

After hearing 50 hours of testimonies and deliberating for three days, the jury has finally come to an agreement and found that Samsung has infringed on three Apple patents, while Apple infringed on one Samsung patent

Apple filed the lawsuit in February 2012, asserting Samsung’s violated five Apple patents with its Galaxy Note, Galaxy Note II, Galaxy SII, Galaxy S II Epic 4G Touch, Galaxy S II Skyrocket, Galaxy S III, Galaxy Tab II 10.1, and other devices. Samsung responded with a counterclaim, stating two Samsung patents were infringed on within the iPhone 4, iPhone 4S, iPhone 5, iPad 2, iPad 3, iPad 4, iPad mini, iPod touch (5th generation), iPod touch (4th generation), and MacBook Pro.

The jury found that:

The jury ruled that Samsung should pay Apple $119,625,000 in damages, which is far from the $2.2 billion Apple was asking for Samsung infringing on its patent. Samsung was claiming it only owed no more than $38M.

The jury also found that Apple infringed on one Samsung patent related to the way FaceTime handles video streaming, awarding the Korean company $158,400 in damages from Apple.

Of course, $119M is pocket change for Apple, but was it ever about money? Probably not. Although these are mixed results, Apple did make a point that Samsung was indeed infringing on some of its patents. This point is likely not as big as Apple would have wanted, making it more of a symbolic win for Apple than a proper victory.

In a statement to Recode, Apple said:

We are grateful to the jury and the court for their service. Today’s ruling reinforces what courts around the world have already found: that Samsung willfully stole our ideas and copied our products. We are fighting to defend the hard work that goes into beloved products like the iPhone, which our employees devote their lives to designing and delivering for our customers.

Even though Samsung must pay Apple almost $120M in damages, you can’t help but think the lawyers for the company are still taking this as a victory, considering the first trial didn’t end up so well for the Korean giant.

Update: While examining the jury’s decision, Apple found it was not awarded damages for the Galaxy SII, which was found infringing on one patent. The jury decided to come back on Monday to sort out damages Apple should be awarded for this.

        You’re missing the point, by more than a mile.
        As others have previously stated, this is about far more than just money or damages, or even a sales ban on devices that no longer have any real time effect in the cellular market.

        This is all a massive PR game.
        This is Apple successfully proving in court (yet again) that Samsung is a copycat. In other words, for many neutral observers (and potential customers) who don’t read in to the story too much and just look for the bottom line, that bottom line is that Samsung copied Apple. And the obvious implication is: “Why buy a copycat product when you can buy the original?”.

        Samsung itself is obviously effected by this, considering its recent moves to try and preempt Apple based on rumors, conjunction and speculation alone, within the smart-watch realm as well as within the health realm. Its trying to prove that its not simply a cloner of Apple’s design and ideas, but that it can innovate on its own. So far, they have continued to fail at that task. I wonder why… 🙂

    Here’s an excerpt from one:

    “A remote video transmission system for digitizing and compressing an audio/visual signal, transmitting that signal over low band width lines, such as land telephone lines, cellular telephone lines, or radio frequencies…Components of this system include: A remote unit, a host unit, and a playback unit”

    So, to transmit video remotely, you need a server, a client and way of connecting the two. That wouldn’t be like completely frigging obvious in any way, now would it? (Patents are supposed to be non-obvious to be awarded.)

    The problem is that we have juries that have absolutely no frigging clue about the subject on which they’re asked to make important decisions. These verdicts are Russian Roulette.

    Apple and samsung are two faces for the same coin. Belive it or not they both want you to pay for thier product if its good or bad so why people even bother caring about them going to curt and that amount of money is not coming from samsung its coming from our pockets in the first place. Samsung can sell you its flagship one dollar more from its initial release and boom all the 119.6 is covered using your money and same goes for apple. What im trying to say is that even if you are a fan for apple or samsung. You should be more critical in thinking and we must try to push the competition in the durection of lowering the price of smartphones not wasting our time on things like patents and stuff that are already being exploited by modders

    Oh. My God. People, people PEOPLE. Copy, copy, copy, copy. Is that the only word over 90% of you know? COPYING is when something is made identical to something else. When Apple introduced Control Center, it’s not “copying” the quick toggles of Notification Center in Android. It may have the same general idea, but it’s not an exact replica. same with Samsung. Their fingerprint scanner isn’t an exact copy of TouchID in the iPhone 5S. This word should not be misused as much.
