The GeoHot Versus Sony Shenanigans Are Over as George Hotz Settles With Sony

By , Apr 11, 2011

Well, that didn’t exactly resemble a grand finale at a fireworks show, but it provided some good water cooler discussion during its peak.

The George Hotz aka GeoHot Versus Sony litigation is done. It’s over folks, it’s time to take your ball and go home.

This afternoon, Sony — no doubt grinning ear to ear from their “win” — posted an update on their blog that outlined some of the settlement terms…

As part of the settlement terms GeoHot has agreed to never again distribute his PS3 jailbreak software. Uh, Sony, you do know that this is literally everywhere on the Internet, don’t you?

I guess they’re satisfied with a moral victory in this case, since there was pretty much nothing else they could do to prevent its spread online.

No doubt many of Hotz’s supporters will be disappointed with his post-litigation statements.

“It was never my intention to cause any users trouble or to make piracy easier,” said Hotz, “I’m happy to have the litigation behind me.”

While it was true that GeoHot never intended for his tools to be used for piracy, Sony obviously wasn’t hearing it.

Both parties expressed satisfaction that litigation had been quickly resolved. “Sony is glad to put this litigation behind us,” said Riley Russell, General Counsel for SCEA. “Our motivation for bringing this litigation was to protect our intellectual property and our consumers. We believe this settlement and the permanent injunction achieve this goal.”

This puts a quick ending to what seemed as if it was heading for a long and drawn out litigation.

If you can remember, GeoHot asked for donations a while back to help fight the case. He received so much support (maybe even from Microsoft), that he put an end to the donations, and was confident that he could remain “lawyered up” to fight Sony’s accusations.

Now that he is settled, many in the jailbreak community are understandably disappointed. What happened to the so-called fight? What’s going to happen to all of the goodwill and money that he collected from the community?

I think that there will certainly be some sort of backlash from the community against GeoHot, but then again, we don’t know all of the details of the settlement.

Still, it’s disappointing to see a guy who went from making rap diss videos, to walking away with his tail between his legs.

But give him some benefit of the doubt. I guess if you’ve never been in that situation, it’s hard to relate to what he’s going through.

What do you think?

Lol really? A tail between his legs? Hes one guy versus a multibillion dollar company in a court case where his chances of winning are slim.

Anyone of us would be shitting ourselves if we were in this position.

I hope he keeps the money, its about time he got paid for what hes done for the community.

    • http://www.wix.com/pwnhkr/phi PwnHkr

Your dumb. if u wudda read before donating it says any funds donated to him and not used will be given to a charity. the link is on his website.

    • William

PwnHKr is simply incapable of posting comment without attacking others, people like him is the only reason why things always get unnecessarily heated.

  • rainrose

Geohot I need your easy jailbreak!!!

  • George W. Bush

Please stick to iPhones your retard hotz. Hes a druggy I know it. Hes popping those OC like crazy. One days hes going to piss someone off and they will put im in a ditch.

  • Jeff

GeoHot says we boycott Sony, I say we boycott GeoHot. Since I first heard about him he has been extremely immature, trying to cause drama in the scene telling us he has a jailbreak but he’s not going to release it and then he accepts thousands, maybe hundreds of thousands of dollars from scene members claiming he is going to fight Sony to the death, posting videos and rants and then he settles like a pansy…. What a loser this kid is.

    • Fried Onion

You do realise that he is not paid for jailbreaks… its a community service…

  • sam

    geohot = saviour of mankind

    These hackers already screwed PSN.
Sure sony was medieval on geohot’s ass and washed his brain.
Maybe during his visit here in south america he took too much sun and got lazy.
    I was expecting more fun!
Where are the nerds who donated all that money? Dorks!

  • starnet5

Yeah, Geohot running away like a pussy, no surprise here. What a jerk. He may be smart, but still a jerk.

  • rollingthunder

You can’t imagine what it is to face the basically limitless coffers that a company like Sony can bring to a lawsuit.

They could easily afford to keep this hanging over him for years.

There was no win for him in this, and getting out as he did allows him to focus on the other things he does, despite the comments of some ingrates.

As for the money he collected – let’s see if he does the right thing and donates it to a charity.

  • dabe

Until you’ve actually been sued you have no idea how stressful and time consuming it is. The guy probably just wanted his life back and to put it behind him. Does seem kind of like BS to ask for donations though, for a legal battle that never happened. If he hasn’t already spent all the money he should donate it to the dev team efforts or some charity

    • YourFriendBen

Yeah, appease the donators and give any extra money to a organization that will continue what he now has agreed to not to do himself anymore. I have never said anything I’ll about him as most of his behaviors fall into “normal” ways people would react and respond to things given his position. But it would have been nice to see him follow through with the fight as he been asking for attention from the beginning. Again that’s fine to ask for attention but deal with it when you get it, and when you ask people to help you dig yourself out a hole, don’t just run away when you get your second kneed up on the ledge. I am though agreed with the author when it comes to logical thought, who knows how it would really be to be sued and have your life taken away for a good duration of time. Can’t say I have, but sure would have liked to see Sony not be a victorious “Biff Taner”.

  • John Crate

Good for him, bet he’s glad it’s over…as far as win for Sony?? How?? Geohot won, he still jb the unjailbreakable ps3.
Now, if he can focus on apple and jb the iPad 2 I’d be a happy camper!!

  • Tom

Cut GeoHot a break. He is a very smart young man who will mature with age. I would not be surprised if GeoHot starts his own tech company one day and grows larger than Sony within 10 years. I think his settlement with Sony was financially wise. If Sony had won a multi-million dollar judgement against him, that may have been too big a hole to ever climb out of and destroyed any future for him.

  • donnana

I’m glad to see it over so (seemingly) simply. So he doesn’t distribute the PS3 jb, fine. It’s either already available in numerous locations, or there may be minions involved (surely a guy of this stature has minions). I always appreciated what he did in the iPhone world, and I second the thought of donating the (remaining) money to the Dev Team’s efforts!

  • kroll.inc

Forget about sony GeoHot.. Now focus on iPad2 JB..not forget about incoming iOS 4.3.2 and iOS5. Focus on iOS will be better..

  • jason

Back to the idevices business again
The legendary GeoHot will unlock your iPhone 4 soon …I’m glad it’s 0ver so GeoHot has more time and stress free :)

  • Ethan

In my personal opinion. Look like someone, you-know-who already received a large sum of money from donations and now, I suspect that he just received an even LARGER sum of money from Sony to leave things behind. And who remains the suckers of this whole drama? I would say that WE ARE. Things happened in Egypt have shown us the power of people, ” the power of more”. Things have happened between Geo Hotz vs Sony have shown us “the power of more…….money”. Sad, just purely sad.

  • DomPerignon

Sony didn’t win anything. The jailbroken code for PS is out for everybody to use it, and Sony can’t do anything about it. Geohot, just got rid of a weight he was carrying on his back and that was a smart thing to do. Well done Geohot! Good luck on your future endeavors.

  • Fredixx

I have nothing but admiration for this guy.
To the people here who bad mouth about him: most geniuses have their quirks, and without Geohotz Limerain exploit you wouldn’t have been able to unlock 4.2.1 in the first place as it was used by Redsnow AND Greenpoison. Give him a break. If you were that smart you would not need people like him. I hope he returns to what he does best: make easy to use and reliable jailbreaks for Windows users.

Sorry it was published 3x. Not my bad: it kept on saying i should check for errors. Still mean what I said, though.

  • EduGeek

This isn’t a win for Sony, It’s a win for George. He still punked them and the source is still widely available. Piss on you Sony for acting like morons for someone doing something totally legal.

  • Zigge

He was right to do that, come on it’s one man vs sony. I would have done the same thing. I think he should return some money if he got too much but otherwise keep it.

There have been some reports that Anon has managed to bring down a few of Sony sites in support of geohot. I’d say its Sony’s tale that is between its legs not geohots. With Anon entering the scene, Sony might have realized that it is now getting more complicated that they thought it would. So they decided to just drop it. As for collecting donations, that was the right thing to do at the time. Now that it is unpredictably over (and who wouldnt it to be over) i guess he should enjoy it. Not like he has not done anything for you people!

  • JustSomeGuy

This one guy stood up to Sony and said “fuck you!” – Hardly his tail between his legs. The object behind litigation is to get it to stop. Anonymous got involved and Sony immediately settled. You want to know who has their tail between their legs? It’s Sony. They backed out and pumped up the bravado knowing they were about to get slaughtered.

  • http://gmail Tbv

I think he did the right thing. He would have wasted too much time in court against Sony. Screw Sony. I would not waist a dime on any more Sony products.
Geo, go back to what you do best, iPhone jailbreak and unlocks. The DEV team would be more motivated to produce when they have you around being their competitor.

  • Eldaria

Now we know what he needed all those donations for.
I’m not impressed, if you tell everyone that you are going to fight if just you get enough donations, then you see it through, this is badwill for both him and Sony, no matter how it would have ended he would either be a hero or martyr, now he is just the one who cheated everyone for money to settle.
I can’t believe I donated to this guy, great iPhone Jailbreaks, don’t have a PS3 but still donated for the cause.

Actually, how will this affect future situations when others jailbreak consoles?
In one end it would have been a disaster if he lost as it would set presedence or whatever i is called.
But what happens now when he settled, it’s all still in limbo?

  • Smitty

As soon as I heard he went to South America I knew he was blowing the donation cash. That’s not what we gave the money for. Unless he donates the rest of it to a reputable cause, I don’t think the community will be so quick to donate in the future.

  • msxy

geo we want unlock for new baseband!!!!!!!!!!

  • Rick

Geo, stick to apple, and start releasing real Jailbreaks and unlocks…

  • http://www.wix.com/pwnhkr/phi PwnHkr

You guys are all selfish. almost every comment has to do with you wanting him to develop a jailbreak and/or unlock for you to use on your phone. HE HAS A LIFE PEOPLE. one that doesnt involve people like you. stop bugging him for a jailbreak he’ll do it when he feels like it, if he feels like it. and for all the dumb asses askinf for your money back, its not yours anymore. if you would have read everything on hs site when you donated there is no refund. it goes to a charity. greedy people.

    • msxy

hey man we aren’t selfish but he is the best hacker i know till now and he is the only one who could do it instead of waiting sherif hashim and the dev team always saying oh!!! we have a vuln… and then woushhhh we doesn’t hear anything exept problems :p.

here in africa we can’t unlock our phones because at&t or verizon or orange and other carrier’s aren’t here we just have Airtell and vodacom who are the best but sucks :p. i have an unlock that i get it from itunes but other people no, u seee i am not selfish but i want to show this guys who is geo.

  • Shan

Ya. He agreed not to desribute sony jb software. But it does’t mean he can’t program them.

  • mk

For fuck’s sakes, it was a donation. Not meant to be refunded.

  • Eddie

I wonder if Sony offered him a job.
It would make sense to do that.
    Smart kid. :-)
Money to Japan = good result.

  • h2

It doesn’t matter if he settled. The PS3 is a dead POS console anyways, and without the JB it’s useless.

  • Beat-boomö

Honestly this pan thing has this going down and for those who say screw Sony If u got a ps3 tv or DVD player with Sony on it it he idiot

  • Tony

Well just wanted to say, I fully understand why he has settled, and for all those who wanted there money back are more stupid then Sony…sad to see he will not release any more but maybe he makes them and someone else releases them :-) would be nice..

  • UNBOUND

i just want to play games remotely like it tricked me into believeing it could before i bought my psp which became obsolete since it doesnt have two analogs but now its going to so i can buy another?Fu Q SCEA with jailbreak u can play any game remotely and being able to copy games to hdd lets me switch games without getting up faster loading and saves your original. • UNBOUND

I JUST SOLVED SONY S PROBLEM WITH JAILBREAK ITS UNDERSTANDABLE FOR THEM TO NOT WANT PIRACY AND FIGHT ALL THE WAY, BUT WE HAVE THE RIGHT TO OUR PROPERTY SO IF JAILBREAK WAS DESIGNED TO REQUIRE YOUR SERIAL NUMBER FROM YOUR GAME TO PREVENT MULTIPLE USERS OF ONE GAME THEN THAT WOULD HELP WITH THE COPYING PROB

  • http://www.n.dk Smith

He wasnt alone against Sony, his team ( around 100 members ) also got sued…
